Policy & Terms of Service

By booking a session for a Benjamin McDonnell Photography Headshot Popup (the “Event”), you agree to the following terms and conditions:

1. Copyright & Image Ownership

• All images created during the Event remain the sole intellectual property and copyright of Benjamin McDonnell Photography.

• Clients are granted a non-exclusive, non-transferable license to use the final, edited images for personal promotion, casting, self-marketing, and portfolio purposes.

• Images may not be altered, sold, licensed, or distributed for commercial purposes without prior written consent.

2. Deposit & Payments

• A non-refundable deposit is required to secure your session.

• The remaining balance must be paid in full by the day of the Event before your session begins.

• Deposits are non-transferable to other events, sessions, or individuals.

3. Cancellations & Rescheduling

• Deposits are non-refundable under any circumstances, including illness, schedule conflicts, or no-shows.

• If you are unable to attend, you may transfer your booking to another person with prior written approval from Benjamin McDonnell Photography.

• In the unlikely event Benjamin McDonnell Photography cancels the Event, all deposits and fees paid will be refunded in full.

4. Image Selection & Delivery

• Clients will receive a proof gallery (unedited images) for selection.

• Final, retouched images will be delivered digitally within the timeframe communicated at the Event.

• RAW/unedited files are not provided under any circumstances.

5. Retouching & Edits

• Standard retouching includes light skin cleanup, color correction, and exposure adjustments.

• Additional or extensive retouching requests may incur an additional fee.

• Artistic discretion in retouching remains solely with Benjamin McDonnell Photography.

6. Model Release & Usage

• By participating in the Event, you grant Benjamin McDonnell Photography the right to use your images for promotional purposes, including but not limited to website, social media, marketing materials, and print publications.

• If you wish to opt out of promotional usage, you must request this in writing before your session.

7. Liability

• Benjamin McDonnell Photography is not responsible for personal injury, loss, or damage to personal property during the Event.

• Participation in the Event is at your own risk.

8. Agreement

 

By booking your session, you acknowledge that you have read, understood, and agreed to these terms and conditions.
